1. Agreement to Terms
By accessing or using the GMS Enterprise Hospitality Platform, you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, you may not access the service. These terms apply to all visitors, users, and others who access or use the Service.
2. Enterprise License
GMS grants your organization a revocable, non-exclusive, non-transferable, limited license to download, install and use the platform strictly in accordance with the terms of our Master Service Agreement (MSA) and this Agreement.
3. Service Level Agreement (SLA)
We guarantee a 99.99% uptime for core check-in and operational synchronization services. Scheduled maintenance windows will be communicated to your administrative contacts at least 48 hours in advance.
4. Data Ownership
Your organization retains all rights, ownership, and interest in your Guest Data and PMS operational data. GMS utilizes this data strictly for the purpose of providing the agreed-upon platform services and automated workflows.
5. Limitation of Liability
In no event shall NSDBytes Technologies, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
